The Road Accident Fund (RAF) is a South African government entity that provides compensation to victims of road accidents caused by negligent drivers. The RAF is funded by a fuel levy, and its primary mandate is to compensate individuals who have suffered personal injuries or lost loved ones in road accidents. Anyone who has been injured or lost a loved one due to the negligence of another driver on South African roads can potentially claim compensation from the RAF, regardless of whether they were a driver, passenger, pedestrian, or cyclist at the time of the accident. 

 

The Road Accident Fund (RAF) provides compensation to victims of road accidents for a variety of damages and losses resulting from an accident. These may include:

  4. Loss of support
  5. General damages

A claim takes on average 3 - 5 years.  Depending on the circumstances, it can take longer.


  1. Brain injuries.
  2. Spinal cord or neck injuries.
  3. Any kind of amputation.
  4. Physical disability resulting from the accident
  5. Permanent disfigurement
  6. Long-term mental disorder
  7. Permanent and disfiguring scars


The general rule is if it is a hit and run, 2 years from the date of the accident.  Identified vehicles, 3 years from the date of the accident. 


If you are a minor or suffered a severe brain injury, the rules are complex and an attorney should be consulted.


If you were 100% responsible for the accident, you would not have a valid claim.

You can claim directly from the Road Accident Fund, but we strongly advise you against it.   The Road Accident Fund (RAF) has implemented a new, challenging process for claim lodgement. 


The requirements now include attaching various documents, such as a comprehensive accident report and hospital/medical records, before you can even lodge your claim directly with the RAF. This can be nearly impossible for claimants to have all these documents readily available when filing for the first time.
